FORECLOSURE SALE
Default having been made under the terms of that certain mortgage executed by James C. Stokley and Misty Stokley, husband and wife, on the 28th day of October, 2011 to West Alabama Bank & Trust which said mortgage is recorded in the Probate Office of Washington County, Alabama, in Mortgage Book 444, at Page 253, and by reason of such default, having declared all of the indebtedness secured by said mortgage due and payable, and such default continuing, notice is hereby given that, acting under the power of sale contained in said mortgage, West Alabama Bank & Trust will sell at public outcry, for cash, to the highest bidder, before the main entrance of the Courthouse in the City of Chatom, Washington, County, Alabama, at noon or otherwise during the legal hours of sale on July 22, 2026 the following described real estate situated in Washington County, Alabama, to-wit:
Commencing at a found ½ inch rebar at the NE corner of that 3.0 acre tract described in DB 385 at page 7 as being North 89 degrees 34 minutes 27 seconds East a distance of 208.7 feet from an iron at the NW corner of that 3.0 acres, but is actually (South 89 degrees 52 minutes 32 seconds East a distance of 216.65 feet); thence North 80 degrees 00 minutes 09 seconds East, a distance of 377.56 feet to a set ½ inch capped iron on the North margin Washington County Highway #34 (30 feet from centerline); thence, leaving highway, North 10 degrees 07 minutes 12 seconds West, a distance of 185 feet to a set ½ inch reference iron; thence North 10 degrees 7 minutes 12 seconds West, a distance of 23.70 feet to a point in a cluster of blown down trees and the NW corner of this parcel; thence North 79 degrees 52 minutes 49 seconds East, a distance of 417.40 feet to a set ½ inch capped iron; thence South 10 degrees 07 minutes 12 seconds East, a distance of 208.70 feet to a set ½ inch capped iron, on the North margin of aforesaid highway, which is in an irregular curve, concave to the North, having a radius of 1000 feet to a central angle of 24 degrees 05 minutes 33 seconds, and a chord of 417.40 feet bearing South 79 degrees 52 minutes 48 seconds West; thence West along said curve, a distance of 420.49 feet to a point of beginning; contains 2.14 acres, more or less, and is a part of Section 26 and Section 27, Township 8 North, Range 4 West in Washington County, Alabama as per plat of survey of Charles Roe, Registered Surveyor, dated August 18, 2008
Together with the hereditaments and appurtenances thereunto belonging and all fixtures now attached to and used in connection with the premises herein described.
Said sale will be subject to the right of way easements and restrictions of record in the Probate Office of Washington County, Alabama, and will be subject to existing special assessments, if any, which might adversely affect the title to subject property.
Said property will be sold on an “As Is, Where Is” basis without warranty or recourse, express or implied as to title, use and/or enjoyment.
Alabama law gives some persons who have an interest in property the right to redeem the property under certain circumstances. Programs may also exist that help persons avoid or delay the foreclosure process. Said sale will be made for the purpose of paying the indebtedness secured by the above described mortgage, and the proceeds thereof will be applied as provided by the terms of said mortgage. The successful bidder must tender a non-refundable deposit in certified funds made payable to Reynolds, Reynolds & Little, LLC at the time and place of the sale. The balance of the purchase price must be paid in certified funds or by wire transfer by noon the next business day at the Law Office of Reynolds, Reynolds & Little, LLC at the address indicated below unless prior to said sale Reynolds, Reynolds & Little, LLC has agreed to a later date or closing location for the tender of the balance of the purchase price. The Mortgagee reserves the right to bid for and purchase the real estate and to credit its purchase price against the expenses of sale and the indebtedness secured by the real estate.
The failure of any high bidder to pay the purchase price and close this sale shall, at the option of Mortgagee, be cause for rejection of the bid, and if the bid is rejected, Mortgagee shall have the option of making the sale to the next highest bidder who is able, capable and willing to comply with the terms thereof. This sale is subject to postponement or cancellation.
Said sale was originally scheduled for July 22, 2026, at which time the same was continued until August 3, 2026 at 11:00 a.m.
