MORTGAGE FORECLOSURE SALE

Default having been made of the terms of the loan documents secured by that certain mortgage executed by Amber M Helveston, A Single Woman to Mortgage Electronic Registration Systems, Inc., as mortgagee, as nominee for Fairway Independent Mortgage Corporation, its successors and assigns dated November 20, 2018; said mortgage being recorded on December 14, 2018, in Book 516, Page 171 in the Office of the Judge of Probate of Washington County, Alabama. Said Mortgage was last sold, assigned and transferred to Lakeview Loan Servicing, LLC by assignment recorded in Deed Book 210, Page 614 in the Office of the Judge of Probate of Washington County, ALABAMA.
The undersigned, Lakeview Loan Servicing, LLC, under and by virtue of the power of sale contained in said mortgage, will sell at public outcry to the highest bidder for cash before the main entrance of the Court House in Washington County, Alabama during the legal hours of sale (between 11am and 4pm), on the 26th day of November, 2024 the following property, situated in Washington County, Alabama, to-wit:
From the Southwest corner of the Southeast 1/4 of the Southwest 1/4 of Section 52, Township 3 North, Range 1 East, Washington County, Alabama, run East 440 feet to a point; thence run North 890 feet to the point of beginning; thence continue North 100 feet to a point of beginning; thence continue North 100 feet to a point; thence West 150 feet to a point; thence South 100 feet to a point; thence 150 feet to the point of beginning.
Together with the waterline and ingress, egress easements and their terms and conditions as described in the following:
1. Instrument dated August 12, 2016 and recorded on August 15, 2016 in Deed Book 560, Page 160, Washington County, Alabama.
2. Instrument dated March 6, 2018 and recorded on May 23, 2018 in Deed Book 577, Page 260, Washington County, Alabama.
3. Instrument dated September 11, 2018 and recorded on September 12, 2018 in Deed Book 580, Page 173, Washington County, Alabama.
4. Instrument dated May 31, 2018 and recorded on September 12, 2018 in Deed Book 580, Page 175, Washington County, Alabama.
Said property is commonly known as 161 Jackson Street, Malcolm, AL 36556.
Should a conflict arise between the property address and the legal description the legal description will control.
Said property will be sold subject to any outstanding ad valorem taxes (including taxes which are a lien, but not yet due and payable), the right of redemption of any taxing authority, all outstanding liens for public utilities which constitute liens upon the property, any matters which might be disclosed by an accurate survey and inspection of the property, any assessments, liens, encumbrances, easements, rights-of-way, zoning ordinances, restrictions, special assessments, covenants, the statutory right of redemption pursuant to Alabama law, and any matters of record including, but not limited to, those superior to said Mortgage first set out above. Said property will be sold on an “as-is” basis without any representation, warranty or recourse against the above-named or the undersigned. The successful bidder must present certified funds in the amount of the winning bid at the time and place of sale.

The Towers, LLC is proposing to construct a 301-foot Lattice Tower telecommunications tower at 86 Vinegar Bend Rd, Vinegar Bend, Washington County, Alabama 36584 (31 20 28.6 N / 88 24 49.6 W). The tower is anticipated to have dual-red and medium intensity lighting. Interested persons may review the application for this project at //www.fcc.gov/asr/applications and entering Antenna Structure Registration (ASR) Form 854 File Number A1287573 and may raise environmental concerns about the project by filing a Request for Environmental Review with the Federal Communications Commission.
